What is a Code of Ordinances?

Ever wanted to know what the rules and laws are that govern your community? Many of the legal restrictions that exists are in the Ohio Revised Code, the code is the complete collection of all laws and regulations put forward by the State. Individual cities and villages have some limited power of self-governance and have their own versions of a localized legal code called a “Code of Ordinances”.
These ordinances represent a collection of local laws and regulations that govern various aspects of life within every community. The codification process involves organizing and compiling these laws into a structured format, making them accessible to both city officials and the public. Most communities use a legal publishing company to compile these ordinances and then codify them in a reference document that tries to be as user-friendly as possible. A code of ordinances serves many purposes. Primarily, it serves as a legal framework that outlines the rights and responsibilities of individuals and entities within the city. This framework ensures consistency in how laws are applied and enforced, providing clarity and predictability for residents and businesses. Additionally, a code of ordinances helps to maintain order by setting standards for behavior and establishing procedures for addressing violations.
These codes cover a wide range of topics, including zoning regulations, public safety measures, building codes, health standards, and more. By codifying these laws, the city ensures that they are easily accessible and understandable to those who need to adhere to them.
The process of amending the code of ordinances involves adopting new ordinances or modifying existing ones through actions taken by a City Council or City Commission. This legislative body is responsible for reviewing proposed changes to ensure they align with the city's goals and legal standards. Amendments can be prompted by various factors, such as changes in state or federal law, shifts in community needs or priorities, or advancements in technology that necessitate updates to existing regulations.
When amendments are proposed to the Code of Ordinances, it typically goes through a three hearing process, as outlined in state law. Under the three hearing process, an ordinance must be “heard” or presented at a council or commission meetings three times. After it is presented the third time, the council or commission may vote on the matter. There are also so provisions in the state law that the three reading process can be waived, allowing ordinances to only be heard after one hearing. However, a 3/4ths of the public body must agree to waiving the three reading process. Public hearings might also be held to gather feedback from residents and stakeholders. This participatory process ensures that amendments are thoroughly vetted before being enacted.
Once the council reaches a consensus on the proposed amendment, it is formally adopted through a vote. If approved, the amendment becomes part of the codified ordinances and is integrated into the existing legal framework. The updated ordinances are then published and made available to the public through official channels like the websites presented above.
Overall, the codified ordinances serve as an essential tool for governance in local communities. They provide a clear set of rules that guide decision-making processes and help maintain order within the community. By regularly updating these ordinances through amendments adopted by the city council, the community can be assured that its legal framework remains relevant and responsive to changing circumstances in the community.
